In order to access and utilize the AppointYou.com websites (collectively, the “Web Sites”) and related applications made available by AppointYou, Inc. (“AppointYou”), an enrolled user (“Subscriber”) must provide certain identifying information and patient data ("Subscriber Data") as part of the Enrollment registration process and/or implementation of AppointYou’s marketing campaign service applications. This information may include personal identifiers such as legal name, address, shipping address, phone number, e-mail address, "screen name", passwords used to access the Web Sites, and credit card information (“Personal Identifiers”). AppointYou stores such information in order to facilitate performance of its marketing campaign service applications and to customize Subscriber’s experience on the Web Sites and reserves the right to request any additional information necessary to establish and maintain Subscriber’s account for use of the Web Sites.

 

AppointYou may place Internet "cookies" on Subscriber’s computer's hard drive to assist with the performance of its Web Site service applications. A cookie is a text file that is placed on the hard disk by a Web page server. Cookies cannot be used to run programs or deliver viruses to your computer.

 

One of the primary purposes of cookies for the Web Sites is for session information, including information needed to perform its Web Site service applications.

 

Subscribers have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but Subscribers can usually modify their browser setting to decline cookies if they prefer. If Subscriber chooses to decline cookies, he or she may not be able to access some of the features and/or functionality of the Web Sites.

 

The Web Sites may contain electronic images known as Web beacons or Spotlight Tags - sometimes called single-pixel gifs - that allow AppointYou or its third party providers to count users who have visited those pages. Web beacons are not used to access personal information on the Web Sites; they are a technique used to compile aggregated statistics about Web Site usage. Web beacons collect only a limited set of information including a cookie number, time and date of a page view, and a description of the page on which the Web beacon resides.

 

To help AppointYou make e-mails more useful and effective, AppointYou may receive a confirmation when Subscribers open and click on the hyperlinks contained in the e-mail from us if Subscriber’s computer supports such capabilities. AppointYou may also receive information on the amount of time the e-mail remained open (dwell time).

 

 

AppointYou utilizes security measures to protect against the loss, misuse, and alteration of Subscriber Data and other collected information, including Personal Identifiers, gathered from the Websites and AppointYou applications. AppointYou has licensed the industry-standard Security Sockets Layer (SSL) technology that permits encryption of Subscriber Data and Personal Identifiers. This will make such information unusable in the event of unauthorized third-party interception. Additionally, AppointYou has and will maintain appropriate security measures in place at its physical facilities to protect against the loss, misuse or alteration of such information. AppointYou stores Subscriber Data and Personal Identifiers in a secure environment at one or more of AppointYou’s service providers. AppointYou personnel with access to this information have been advised of the importance of maintaining the confidentially of such information and of using it only for the purposes described in AppointYou’s Privacy and Security Policy and/or the Subscription and Use Agreement.

 

Other than as expressly described in this Privacy and Security Policy, AppointYou will not share, sell, or rent information that it collects with anyone outside of AppointYou without your prior permission, or unless AppointYou believes, in good faith, that such release is reasonably necessary to (i) comply with applicable law, (ii) enforce the terms of AppointYou’s Subscription and Use Agreement, or (iii) protect the rights, property or safety of AppointYou or others.

 

The Websites and related AppointYou applications may provide links to third-party sites for Subscriber’s convenience and information. If third party sites are accessed via such links, Subscriber will leave the Websites and AppointYou applications. AppointYou does not control third-party sites or third party privacy practices that may differ from AppointYou’s Privacy and Security Policy. AppointYou does not endorse or make any representations about third-party sites. Any personal information Subscriber chooses to give to such third parties is not covered by AppointYou’s Privacy and Security Policy.

 

Subscribers may access, modify, correct, change or update their information at any time through the enrollment registration page at AppointYou.com by using the applicable functionality available at the Web Sites for updating enrollment registration information. Subscriber’s enrollment registration data and any related information is password-restricted for Subscriber protection. Subscribers may also change their passwords when using the Web Site functionality available to access enrollment registration data.

 

Although AppointYou will use all reasonable efforts to safeguard the confidentiality and security of Subscriber Data and personal information, transmissions made by means of the Internet cannot be made absolutely secure. AppointYou will have no liability for disclosure of Subscriber Data and personal information due to errors in transmission or unauthorized acts of third parties beyond its reasonable control. 

 

AppointYou reserves the right to change or update this Privacy and Security Policy, or any other AppointYou policy or practice, at any time. Any changes or updates will be effective immediately upon posting to the Web Sites, and Subscriber’s use of any of the Web Sites and AppointYou applications following such posting constitutes Subscriber’s acceptance of the Privacy and Security Policy as so changed or updated.
